Welcome to HotelSkills.training! These Terms and Conditions ("Terms") govern your access to and use of the HotelSkills.training website, its Learning Management System (LMS), e-learning course library, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to all these Terms, do not use the Service.
HotelSkills.training is owned and operated by RapidEzy Training Systems, Inc., incorporated in Delaware, USA.
1. Acceptance of Terms
By creating an account, subscribing to a plan, accessing our courses, or otherwise using any part of the Service, you signify your unreserved acceptance of these Terms, as well as our Privacy Policy. We may update these Terms from time to time, and we will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
2. Service Description
HotelSkills.training provides training-as-a-service through an online platform. Our Service includes:

3. User Accounts

Account Creation: To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify HotelSkills.training immediately of any unauthorized use of your password or account or any other breach of security. HotelSkills.training cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Account Types:

Individual Professional Accounts: For personal, non-commercial use by individuals.

Company Accounts: For hospitality businesses to manage their employee training and deliver training courses. This includes features for managing users, assigning courses, tracking progress, and reporting.

College Accounts: For educational institutions to provide learning content to their students. This may include specific features for curriculum integration and student management.

4. Subscriptions and Payments

Subscription Plans: HotelSkills.training offers various subscription plans with different features and durations. Details of these plans, including pricing, are available on request.

Billing: Subscriptions are billed on a recurring basis (e.g., monthly, annually), as per your chosen plan. You authorize HotelSkills.training or its third-party payment processor to charge your chosen payment method for the applicable subscription fees.

Automatic Renewal: Unless you cancel your subscription before the end of the current subscription period, your subscription will automatically renew.

Cancellations: You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of your current billing cycle. No refunds will be provided for any unused portion of a subscription period.

Price Changes: HotelSkills.training reserves the right to change its subscription prices at any time. We will provide you with reasonable prior notice of any price changes.

Taxes: All fees are exclusive of applicable taxes, which will be added to your invoice where required by law.
5. Use of the Service

Permitted Use: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, internal business, or educational purposes, depending on your subscription type, and in accordance with these Terms.

Content: All content provided on the Service, including courses, videos, text, images, and other materials, is the property of HotelSkills.training or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without explicit written permission from HotelSkills.training.
6. Intellectual Property
All intellectual property rights in and to the Service, including but not limited to the LMS, course library, website design, trademarks, logos, and software, are owned by HotelSkills.training or its licensors. These Terms do not grant you any right to use any branding or logos used in our Service.
7. User Content
If the Service allows you to post or upload content (e.g., forum posts, comments, assignments), you retain ownership of any intellectual property rights that you hold in that content. By submitting content, you grant HotelSkills.training a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform that content in connection with the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. HOTELSKILLS.TRAINING DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOTELSKILLS.TRAINING, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
10. Indemnification
You agree to indemnify and hold harmless HotelSkills.training, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Delaware, USA.
12. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and HotelSkills.training regarding the use of the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and HotelSkills.training's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without HotelSkills.training's prior written consent. HotelSkills.training may assign its rights and obligations under these Terms without restriction.
